Terms of Use

Definitions

For the purposes of these Terms of Use, the following definitions apply:

• VENTSY: a digital marketplace platform for renting event venues.
• User: any individual or legal entity that accesses or uses the platform.
• Owner: a user who lists and makes a venue available for rent.
• Renter: a user who searches for and books venues through the platform.
• Venue: a property or location made available by the Owner for events.
• Booking: confirmation of the use of a Venue on an agreed date and under agreed conditions.

Acceptance of terms

By accessing, creating an account or using any feature of VENTSY, the User agrees to these Terms of Use and to the Privacy Policy.

These terms may be updated periodically. Continued use of the platform after notification of changes implies acceptance of the new conditions.

Registration and account

To use the platform’s full features, you must create an account. When registering, the User declares that:

• They are at least 18 years old or have legal authorization from a guardian.
• They have provided truthful, accurate and up-to-date information.
• They are responsible for keeping their password confidential.
• They will immediately notify VENTSY of any unauthorized use of their account.

Use of the platform

The User undertakes to use the platform in a lawful and ethical manner. The following is expressly prohibited:

• Publishing false, misleading, defamatory or illegal content.
• Carrying out financial transactions outside the platform in order to circumvent fees.
• Using the platform for spam, fraud or phishing purposes.
• Attempting to access restricted areas or VENTSY systems without authorization.
• Reproducing, copying or distributing platform content without express permission.
• Interfering with the technical operation of the platform or its servers.

Rules for owners

When listing a venue on VENTSY, the Owner declares and warrants that:

• They have legal authorization to make the venue available for rent.
• The venue’s information, photos and descriptions are truthful and up to date.
• The venue is in adequate condition of use, hygiene and safety.
• They hold all licenses and permits required to host events at the location.
• They will honor confirmed bookings under the advertised terms.
• They will give at least 48 hours’ notice of any inability to fulfill a booking.

VENTSY is not liable for legal irregularities of listed venues, which are the sole responsibility of the Owner.

Rules for renters

When making a booking, the Renter undertakes to:

• Use the venue exclusively for the event declared at the time of booking.
• Respect the maximum capacity of people stated by the Owner.
• Return the venue in the same condition in which it was received.
• Comply with the agreed entry and exit times.
• Be liable for any damage caused to the venue during the event.
• Comply with conduct rules, neighborhood standards and local legislation.

Payments and fees

Payments made through the platform are processed by certified partners. VENTSY charges a service fee on each completed transaction, the amount of which is disclosed before the booking is confirmed.

• The prices displayed are the responsibility of the Owners and may be changed at any time for new bookings.
• Bookings already confirmed have their amount guaranteed as agreed.
• Any bank or currency-exchange fees that may apply are the responsibility of the User.

Paid listing plans (Basic, Pro, Ultra) are billed monthly and renewed automatically unless cancelled by the Owner at least 48 hours before the due date.

Cancellations and refunds

The cancellation policy for each venue is set by the Owner and displayed on the listing page. As a general rule:

• Cancellation by the Renter more than 30 days in advance: full refund.
• Cancellation between 15 and 30 days: refund of 50% of the amount paid.
• Cancellation less than 15 days in advance: no refund, except under the venue’s specific policy.
• Cancellation by the Owner: full refund to the Renter.

Reviews and content

VENTSY allows Renters to publish reviews about venues after the event has taken place. By publishing a review, the User:

• Warrants that the content is truthful and based on a real experience.
• Grants VENTSY a non-exclusive license to display the content on the platform.
• Does not publish offensive or discriminatory content or content that infringes the rights of third parties.

VENTSY reserves the right to remove reviews that violate these guidelines, without prior notice.

Only verified reviews (linked to real completed bookings) are displayed publicly on venue pages.

Liability and limitations

VENTSY acts as an intermediary between Owners and Renters, and is not a party to the rental contracts. Therefore:

• VENTSY is not liable for the quality, safety or legality of the listed venues.
• VENTSY is not liable for material, personal or financial damages occurring during events.
• VENTSY does not guarantee uninterrupted availability of the platform and is not liable for temporary technical failures.

In no event shall VENTSY’s total liability exceed the amount of the service fee charged on the transaction related to the claim.

Intellectual property

All content on the VENTSY platform — including logos, text, design, source code and features — is protected by intellectual property rights and belongs to VENTSY or its licensors.

The reproduction, modification or distribution of any element of the platform without prior and express written authorization is prohibited.

By publishing photos or content on the platform, the User warrants that they hold the rights to such content and grants VENTSY a license to use it on the platform.

Suspension and termination

VENTSY may suspend or terminate an account, at any time and without prior notice, in the following cases:

• Violation of any provision of these Terms of Use.
• Fraudulent behavior or behavior harmful to other users.
• Use of the platform for illegal purposes.
• Provision of false information in the registration or in listings.

Termination of the account does not eliminate obligations already undertaken by the User in previously confirmed bookings.

General provisions

These Terms of Use are governed by the laws of the Federative Republic of Brazil. The courts of the judicial district of Rio de Janeiro — RJ are elected to settle any disputes, waiving any other, however privileged it may be.

The eventual invalidity of any clause does not affect the validity of the remaining provisions of this instrument.
